Ontario\u2019s proposed civil justice reforms aim to tackle delay and inefficiency \u2014 but they risk doing serious damage to access to justice, especially for victims of fraud and people with complex claims. Under the proposed model, litigants would need to marshal their full case \u2014 including sworn evidence \u2014 <strong>before discovery even begins.<\/strong> <\/p>\n\n\n\n<!--more-->\n\n\n\n<p>For those without deep pockets, that\u2019s a serious barrier. For counsel working on complex matters on contingency or limited retainers, it\u2019s a non-starter. <strong>Here\u2019s what\u2019s at stake:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Higher up-front costs<\/strong> \u2013 fewer people can afford to sue.<\/li>\n\n\n\n<li><strong>Procedural inefficiency<\/strong> \u2013 costly duplication and wasted effort.<\/li>\n\n\n\n<li><strong>Fewer settlements<\/strong> \u2013 more trials, more strain on courts.<\/li>\n\n\n\n<li><strong>New disclosure rules favor defendants<\/strong> \u2013 institutional defendants gain advantage over vulnerable plaintiffs. Plaintiffs will face severe restrictions in obtaining critical documents needed to prove their case.<\/li>\n\n\n\n<li><strong>Systemic inequity<\/strong> \u2013 justice for the few, not the many. Asymmetrical cost consequences that hurt individuals and small businesses far more than large corporations are being amped up.<\/li>\n<\/ul>\n\n\n\n<p>If you work with vulnerable clients, fraud victims, or in complex litigation, now is the time to engage. The consultation is open until June 16, 2025.
